Tips for visa status procedures for your new born baby in Japan

Regarding the above artickle which I wrote before, I received a question about baby’s visa acquisition under special situation. I directly asked the question to the immigration bureau of Japan. I want to share with you about information here and I want people under the same situation to refer to this article.

Procedure of baby’s visa when a mother gives birth in her country

The content of the question is something like this. The questioner’s wife is planning to go back to her country to give a brith to their baby. But, he is worried about if his wife returned back to her country for childbirth, she and her baby might not be able to come back to Japan until all procedure of baby’s visa aquisition is done.

I make a list of questioner’s situation down below.

  • The questioner and his wife have work visa in Japan.
  • The questioner is planning to keep staying in Japan.
  • The questioner’s wife is planning to go back to her country to give a birth to her baby
  • He is worried if his wife and baby couldn’t come back to Japan untill all procedure is done.

Basically, a foreigner who lives overseas can come to Japan after visa is issued

If your baby is born in Japan, extention period is given for 30 days until all baby’s visa acquisition procedure is completed. However, if your baby is born overseas, your baby can’t basically come to Japan until your baby is newly granted resident status of Japan by the immigration bureau.

Of course, it is possible to let your baby come to Japan with tourist visa for maximam 3 months but it is not necessarily that baby’s visa can be switched from “tourist” to a certain visa type smoothly while staying in Japan for 3 months. Mostly, your wife and baby ends up going back to your coutnry temporarily, and later, they come again to Japan when your baby is officially granted a long term stay visa.

What is baby’s visa type?

If baby’s parents have work visa in Japan, baby’s visa type should be “Dependent”

Who is the applicant?

In this case, basically a person staying Japan has to go through the procedure of baby’s visa by proxy. For that reason, some necessary documents to be submitted to the immigraiton office needs to be sent from the country where your partner is staying.

What type of application you should fill in

The application form you need to fill in is defferent between the case your baby is born in Japan and the case your baby is born overseas.

If your baby is born in Japan, you fill in the APPLICATION FOR PERMISSION TO ACQUIRE STATUS OF RESIDENCE but if your baby is born overseas, you should fill in the APPLICATION FOR CERTIFICATE OF ELIGIBILITY.

Things to be prepared in the country where baby is born

Baby’s passport

Apply for baby’s passport at the cocerned government agency corresponding to the Ministery of foreign affairs of Japan. You must give priority to getting baby’s passport as early as possible because there is a entry feild of your baby’s passport number on the application for certificate of eligibility.

Baby’s brith certificate

In Japan, babybirth needs to be reported to the municipal office within 14 days after a baby is born and receve the birth certificate.

I am not quite sure what other countries’ municipal procedure of the birth certificate is like but your partner should receive the birth certificate at the municipal office in your country.

You ask your partner to send it to you because it is going to be submitted with the application for certificate of eligibility to the immigration office in Japan.

Baby’s ID photo

Baby’s picture is needed to be attached on the appliation form. You also ask your partener to take a baby’s ID photo beforehand and send it togather with baby’s birth certificate. The required piture size is 30mm (width) x 40mm (height).

Things to be prepared before your partner goes back to her country

  • You and your partner’s certificate of employment (the office where you and your partner work for)
  • Resident tax taxiation certificate (Municipal office)
  • Tax payment certificate (Municipal office)

Conclusion

These are all you have to prepare to apply for your baby’s dependent visa in Japan and basically, if your wife goes back to her country to give a birth to her baby, she and her baby can’t come back to Japan until all procedure is done.

If you and your partner have job in Japan, I recommend not to let your partner go back to her country to give a birth because it may take a long time until your baby is granted visa by the immigration bureau of Japan. Please carefully decide where your wife is going to give a birth to your baby.
